(hereinafter referred to as the “Provider”)

Payments on-site may be made in cash or by bank transfer.
1. Scope of Application
- These Terms and Conditions apply to all contracts concerning the rental of holiday bungalows for accommodation purposes, as well as all additional services and supplies provided by the Provider to the Guest. All services are rendered exclusively on the basis of these Terms and Conditions.
- Subletting or re-letting the holiday bungalow, in whole or in part, or using it for purposes other than accommodation, requires the Provider’s prior written consent.
- Any deviation from these Terms and Conditions shall only be valid if expressly confirmed by the Provider in writing.
2. Accommodation Agreement; Minimum Age
- The accommodation agreement is concluded when the Provider confirms the Guest’s booking request by telephone, post, email, LINE, or any other written communication and thereby accepts the booking.
- The contracting parties are the Provider and the Guest. If a third party makes the booking on behalf of the Guest, such third party shall be jointly and severally liable together with the Guest for all obligations arising from this agreement, provided that the Provider has received a corresponding declaration from the third party.
- The Guest is obliged to review the booking confirmation for accuracy. If the content of the booking confirmation differs from the booking request and the Guest does not object without undue delay, the contents of the booking confirmation shall be deemed accepted and contractually binding.
3. Services; Prices; Payment; Deposit; Set-Off
- The Provider shall make the booked holiday bungalow available to the Guest and provide the agreed services. The bungalow shall correspond to the specifications and amenities published on the Provider’s website.
- The Guest shall pay the applicable or agreed prices for the accommodation and any additional services used. This shall also apply to services and expenses incurred by the Provider on behalf of the Guest through third parties.
- All prices include any applicable statutory value-added tax (VAT).
- The Guest must provide accurate information regarding the number of occupants. The bungalow may only be occupied by the number of persons specified in the booking confirmation. Occupancy exceeding this number requires the Provider’s prior written approval. In such cases, the accommodation rate shall be adjusted in accordance with the Provider’s standard rates for the applicable occupancy level.
- A deposit of 50% of the agreed accommodation price shall be due within fourteen (14) days after the booking confirmation has been issued. If payment is not received within this period and remains unpaid after a reasonable grace period specified by the Provider, the Provider shall be entitled to withdraw from the agreement by written notice. In such case, the cancellation provisions set out in Section 5(3) shall apply, with the fourteenth day after the booking confirmation being deemed the cancellation date.
- The remaining balance of 50% shall be payable one (1) month prior to arrival. If the balance is not received by that date and remains unpaid after a reasonable grace period specified by the Provider, the Provider shall be entitled to withdraw from the agreement by written notice.
- For bookings made less than one (1) month prior to arrival, the full accommodation price shall be payable immediately by bank transfer. If, due to the short notice, a transfer is not feasible, payment must be made in cash or Thai QR Payment upon arrival unless the Provider has expressly agreed to another payment method. Debit cards and credit cards cannot be accepted on-site.
- The Guest may only set off claims against the Provider where such claims are undisputed or have been finally determined by a court of competent jurisdiction.
4. General Rights and Obligations; House Rules
- The Guest shall treat the bungalow and all furnishings with due care and shall comply with the house rules. Quiet hours apply from 10:00 PM to 6:00 AM. During these hours, particular consideration must be shown to neighbours and other guests. Television, audio equipment, and similar devices must be kept at room volume.
- When leaving the bungalow, the Guest shall ensure that all windows and doors are closed and that air-conditioning units, lights, and electrical devices are switched off.
- Dogs are not permitted in the holiday bungalows.
- Smoking is prohibited inside all bungalows. Designated smoking areas are provided. Smoking is permitted only on terraces and in the salas. In the event of a violation, the Provider may charge a cleaning fee of up to THB 200.
- The installation or attachment of decorations or similar items inside the bungalow is prohibited. The Guest shall be solely responsible for any decorations installed or attached and shall indemnify the Provider against any third-party claims arising therefrom. The Guest shall also compensate the Provider for any damage resulting from such decorations.
- The Provider shall have the right to access the bungalow at any time in cases of emergency or urgent necessity. In exercising this right, the Provider shall take reasonable account of the Guest’s legitimate interests. The Provider shall inform the Guest in advance whenever reasonably possible.
5. Cancellation and Withdrawal
- Any cancellation by the Guest requires the Provider’s written consent. Without such consent, the agreed accommodation price remains payable even if the Guest does not make use of the booked services, except where the Provider is in default or unable to perform its obligations for reasons attributable to the Provider.
- The Guest may only withdraw from the agreement without incurring payment or compensation obligations if a written right of withdrawal has been expressly agreed between the parties up to a specified date. Such right expires unless exercised in writing by the agreed deadline.
- The Guest may cancel the booking under the following conditions:

All cancellations must be submitted in writing unless the Provider expressly agrees otherwise. The date on which the cancellation is received by the Provider shall be deemed the effective cancellation date. - Where the bungalow is not used by the Guest, the Provider shall credit any income obtained through alternative rental and any expenses saved.
- The Provider shall also be entitled to withdraw from or terminate the agreement for good cause, including but not limited to the following circumstances:
a) Force majeure or other circumstances beyond the Provider’s control make performance impossible;
b) The bungalow was booked using misleading or false information regarding the Guest, the purpose of stay, occupancy, or accommodation of animals;
c) The bungalow is used for purposes other than accommodation;
d) The Provider has reasonable grounds to believe that the use of the accommodation may jeopardise the safety, peace, reputation, or legitimate interests of other guests, neighbours, or the Provider. - The Provider shall inform the Guest without undue delay of any exercise of its right of withdrawal or termination. In cases of force majeure, all payments already made shall be refunded promptly. Where the Provider validly withdraws from or terminates the agreement, the Guest shall have no claim for damages.
- Guests are strongly advised to obtain travel cancellation and travel interruption insurance.
6. Liability; Limitation Period
- The Provider shall be liable for its contractual obligations only in cases of wilful misconduct or gross negligence, except where mandatory law provides otherwise. If disruptions or defects occur, the Provider shall endeavour to remedy them upon becoming aware of them or upon prompt notification by the Guest. The Guest shall cooperate to the extent reasonably required in mitigating any disruption or damage.
- The Provider accepts no liability for property brought onto the premises by the Guest, including motor vehicles. This exclusion expressly applies to valuables stored or left in the bungalow. Any property brought onto the premises is at the Guest’s sole risk.
- The Guest shall be liable for any damage caused by the Guest, accompanying persons, or visitors to the bungalow or its inventory. Any damage must be reported to the Provider without undue delay, particularly where such damage may affect other accommodation units (e.g., water or fire damage).
- Claims by the Guest shall become time-barred after six (6) months unless based on intentional misconduct by the Provider. Claims by the Provider shall be subject to the applicable statutory limitation periods.
7. Arrival and Departure; Keys
- The bungalow shall normally be available from 2:00 PM on the day of arrival. Any alternative arrival arrangements must be agreed with the Provider.
- Upon arrival, the Guest shall present the booking confirmation.
- On the day of departure, the bungalow must be vacated no later than 11:00 AM.
- Guests who receive a key upon check-in must pay a cash deposit of 200 THB. This amount will be refunded in cash upon the return of the key at check-out.
- Departure shall not be deemed complete until all keys have been returned to the Provider or the Provider’s representative. The Guest shall ensure that the bungalow is properly locked when leaving.
- In the event of the loss of one or more keys, the Guest shall reimburse the Provider for replacement costs and, where necessary, the installation of new locks.
8. Data Protection
Personal data provided by the Guest shall be stored electronically by the Provider and shall not be disclosed to third parties unless such disclosure is necessary for the performance of the contract or required by applicable law.
9. Final Provisions
- Any amendments or supplements to the agreement, booking confirmation, or these Terms and Conditions should be made in writing. Unilateral amendments by the Guest shall be ineffective.
- This agreement shall be governed exclusively by the laws of the Kingdom of Thailand.
- To the extent legally permissible, the exclusive place of jurisdiction shall be Uthai Thani, Thailand. If either party has no general jurisdiction in its country of residence, Uthai Thani, Thailand shall likewise be the exclusive place of jurisdiction.
- Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic and legal intent of the original provision. The applicable statutory provisions shall apply in all other respects.
